Mr Rodolph's fitness to practice as a registered health professional is impaired by reason of his misconduct whilst employed by Birkenhead and Wallasey Primary Care Trust, in particular that he examined three female patients in an inappropriate manner in June and July 2005.

Hearing in Private
1. The Registrant applied for the hearing to be held in private. The HCPC indicated that this was a matter for the Panel. The Panel accepted the advice given by the Legal Assessor and was referred to the HCPC Practice Note on “Hearings in Private”, (2017). The Panel decided that notwithstanding the usual position for hearings to be held in public, it exercised its discretion for the hearing to be held in private.
2. The Panel noted the allegation set out on the HCPTS website was different from the allegation contained in the previous panel’s decision document. It was also different from the allegation read out to the previous panel as set out in the transcript of the previous hearing. The Panel took the opportunity to indicate that the HCPC website should have placed upon it only the public version of the allegation and decision of the previous panel.
3. Overall, the Panel is not satisfied that the Applicant has provided sufficient evidence:
a) That he has met the general requirements for registration and therefore that there is no risk to patients;
b) That he is a fit and proper person. Whilst he is clearly enthusiastic about returning to the profession, he continues to lack insight into the findings made in 2007.
