Preliminary Matters
Service
1. The Panel had sight of information that Notice of these proceedings was posted to the Registrant at her registered address on 23 October 2018 and that, on the same date, a copy was emailed to her at her registered email address. The Panel was also provided with un-redacted copies of the correspondence with the Registrant and an extract from the Register showing the Registrant’s address. The Panel determined that Notice of this hearing had been properly served in accordance with Rules 3 and 6 of the Health and Care Professions Council (Health Committee) (Procedure) Rules 2003.
Proceeding in absence of the Registrant
2. The Panel heard the submission of Ms Wills on behalf of the HCPC to proceed in the absence of the Registrant. Ms Wills informed the Panel that the Registrant has not replied to the Notice of today’s hearing. She said the Registrant has not been in contact with the HCPC since an email from her dated 1 December 2017. In summary, Ms Wills informed the Panel of attempts made to engage with the Registrant including: correspondence posted to the Registrant was returned in the post; an email to the Registrant dated 21 February 2018; and a further letter dated 22 November 2018 sent by email to the Registrant reminding the Registrant of today’s hearing, and informing her that she has the option of attending by telephone or sending written submissions. Ms Wills confirmed that she received no reply.
3. The Panel accepted the Legal Assessor’s advice and took into account the HCPTS Practice Note on ‘Proceeding in Absence of the Registrant’.
4. The Panel noted that the Registrant did not attend the substantive hearing and that subsequent to this hearing she has not replied to attempts made by the HCPC to contact her. The Panel was mindful that it should exercise its discretion to proceed in the absence of a Registrant with utmost care and caution. In reaching a decision the Panel took into account any potential disadvantage to the Registrant if it were to proceed today. However, taking into account the lack of a response or request for an adjournment from the Registrant and the fact this was a mandatory review, the Panel was satisfied that it is fair and in the public interest, for today’s review to proceed expeditiously.
Proceeding in Private
5. Ms Wills made an application for this case to be heard entirely in private on the basis that the Allegation solely relates to the Registrant’s health. The Panel decided to allow the application pursuant to Rule 10(1)(a) of the Health and Care Professions Council (Health Committee) (Procedure) Rules 2003. Accordingly, the Panel directed that the whole of the hearing should be held in private.

Order

The Registrar is directed to suspend the Registration of Miss Anesu Dodzo for a further period of 12 months upon the expiry of the current order.
