Allegation
The following allegation was considered by a Panel of the Health Committee at the substantive hearing on 10 November 2016:
Your fitness to practise as an Operating Department Practitioner is impaired by reason of your physical and/or mental health.
Finding
Preliminary Matters
Service
1. The Panel found that there had been good service of notice of these proceedings, in accordance with rule 3 of the Health and Care Professions Council (Health Committee) (Procedure) Rules 2003.
Proceeding in Private
2. The Panel decided that as the evidence relates almost exclusively to the Registrant’s health, the hearing would be conducted entirely in private.
Proceeding in the Absence of the Registrant
3. In deciding whether to exercise its discretion to proceed in the absence of the Registrant, the Panel took into consideration the HCPTS practice note entitled ‘Proceeding in the Absence of a Registrant’. The Panel weighed its responsibility for public protection and the expeditious disposal of the case against the Registrant’s right to a fair hearing. In reaching its decision the Panel took into account the fact that the Registrant had not engaged with these proceedings from the beginning, and did not attend the substantive or review hearing. The Panel also took into account the public interest that this substantive Order is reviewed before it expires. The Panel heard a submission from Ms Simpson that the Registrant had voluntarily absented herself from the hearing and was satisfied that it was unlikely that an adjournment would result in the Registrant’s attendance at a later date, in the light of her past non-engagement. The Panel concluded that the Registrant is aware of the hearing today and has waived her right to attend this hearing. The Panel is satisfied that a fair hearing can take place in the absence of the Registrant and that it is in the public interest for this hearing to proceed.
Decision
4. The Panel imposes a Striking Off Order from the date that the current Suspension Order expires.
Order
The Registrar is directed to strike the name of Miss Tania Myhre from the Register on the date this Order comes into effect.
Notes
The Order imposed today will apply from 8 December 2018.
