Allegation

By reason of your physical and/or mental health, your fitness to practise as a Social Worker is impaired.

Finding

Preliminary - Private

1. The Panel heard and accepted the advice of the Legal Assessor and concluded that the hearing should be held in private given the health issues arising. It noted that hearings before a panel of the health committee were held in private but to avoid any ambiguity and to protect the private life of the Registrant it concluded it was appropriate and in the interests of justice to conduct this hearing in private.

Decision
2. The Panel determined, given the finding on 17 July 2018 of impairment due to her health, that if the Registrant at any time wished to return to the profession she would be required to satisfy the Registrar, at that time, that her health condition had resolved before resuming practice. Imposing a sanction would not be appropriate or proportionate. 
3. The Panel concluded that the public and the wider public interest is therefore protected.   There is no risk to public safety as the Registrant cannot return to the profession without establishing that her health condition has resolved and that she is fit to practise. Further, an informed member of the public would not expect that a Registrant with such a health condition should be subject to a sanction in the circumstances of this case.  The Panel determined that the wider public interest does not require the imposition of a sanction. 
4. The Panel further reminded itself that this was not a case where the Registrant’s fitness to practise had been found to be impaired because of any misconduct or lack of competence on her part, rather it was due to an enduring health condition. In such circumstances, the Panel therefore considered that the Registrant should be allowed to leave her chosen profession with dignity. It imposed no Sanction and allows the current Suspension Order to lapse on its expiry.
