Allegation

While registered as a Physiotherapist:

1) On or around 23 September 2013, during an appointment with Patient A, you;

  1. a) Lowered Patient A’s underwear and/or asked Patient A to lower her underwear to below her buttocks, exposing Patient A’s genitals.
  2. b) Touched Patient A’s exposed genitals.

2) On or around 2 October 2013 during an appointment with Patient A, you;

  1. a) Lowered Patient A’s underwear and/or asked Patient A to lower her underwear to below her buttocks, exposing Patient A’s genitals.
  2. b) Touched Patient A’s exposed genitals.
  3. c) Moved Patient A’s underwear to one side, exposing her genitals.

3) On or around 14 October 2013 during an appointment with Patient A, you;

  1. a) Lowered Patient A’s underwear and/or asked Patient A to lower her underwear to her knee level, exposing Patient A’s genitals.
  2. b) Touched Patient A’s exposed genitals.
  3. c) Massaged Patient A’s exposed genitals.

4) On or around 2 October 2013 and/or 14 of October 2013 you performed Pectineus and/or Rectus Abdonimus trigger point needling on Patient A, without clinical justification.

5) In or around 2009 and/or 2010, during an appointment with Patient B, whilst Patient B was laid on her back, you lifted Patient B’s trousers and underwear away from her body exposing her pubic region.

6) In or around 2009 and/or 2010, during an appointment with Patient B, removed Patient B’s underwear and/or asked Patient B to remove her underwear.

7) Between October 2013 and December 2013 you retrospectively altered Patient A’s clinical records.

8) Your actions at particulars 1, 2, 3, 5, 6 were sexually motivated.

9) Your actions at particular 7 were dishonest.

10) The matters described at particulars 1, 2, 3, 5, 6, 7, 8, 9 amount to misconduct.

11) The matter described at particular 4 amounts to misconduct and/or lack of competence.

12) By reason of that misconduct and/or lack of competence, your fitness to practise is impaired.

This is to advise you that the Health and Care Professions Council intends

to apply to a Panel of the Conduct and Competence Committee on the day of the hearing to formally amend the allegation.

This is to clarify the allegation against you and better reflect the evidence.

The allegation that will be put before the Panel is as follows (I have italicised and bolded the amendments for your reference): While registered as a Physiotherapist:

1) On or around 23 September 2013, during an appointment with

Patient A, you;

  1. a) Lowered Patient A’s underwear and/or asked Patient A to lower her underwear to below her buttocks, exposing Patient A’s genitals.
  2. b) Touched Patient A’s exposed genitals.

2) On or around 2 October 2013 during an appointment with Patient

A, you;

  1. a) Lowered Patient A’s underwear and/or asked Patient A to lower her underwear to below her buttocks, exposing Patient A’s genitals.
  2. b) Touched Patient A’s exposed genitals.

A, you;

remove her underwear.

7) Between October 2013 and December 2013 you retrospectively altered Patient A’s clinical records.

8) Your actions at particulars 1, 2, 3, 5, 6 were sexually motivated.

9) Your actions at particular 7 were dishonest.
