Allegation

Your fitness to practise as an Operating Department Practitioner is impaired by reason of your health.

Finding

Preliminary Matters

1. The application being considered by the Panel is one jointly made by the HCPC and the Registrant, Mrs Pauline Wilson, seeking the voluntary removal of the latter from the HCPC Register.  It is relevant to note that until Thursday, 25 July 2019 the Panel was expecting to conduct the final hearing of an allegation that the Registrant’s fitness to practise was impaired by health concerns, and, in connection with that anticipated final hearing, the Panel was provided with a hearing bundle that included full medical reports.

2. The Panel was satisfied that the Registrant understood that the matter was to be decided today.  In relation to the final hearing originally contemplated, there was a notice of hearing sent on 1 May 2019.  In relation to the hearing as one concerned with voluntary removal, on 24 July 2019 the Registrant returned the Voluntary Removal Agreement which provided for the “operative date” of removal to be today’s date, and a further notice of hearing in relation to the voluntary removal agreement was sent on 25 July 2019.

3. The Registrant did not attend the hearing. The Panel acknowledged that she was entitled to attend. The Panel was informed that the Registrant telephoned an HCPC Administration Officer this morning to say that she was unable to attend the hearing because she was caring for her mother.  The Panel considered it appropriate to proceed with the hearing in the absence of the Registrant, not least because not to proceed with the application would frustrate the Registrant’s clearly expressed wish to have her name removed from the HCPC Register.

4. The Panel is sitting as the Health Committee and the matter is concerned with the Registrant’s health. Accordingly, the Panel determined that it was appropriate for the hearing to be conducted in private.  For the same reason this determination should be treated as private.  In the judgement of the Panel it is not appropriate for there to be a public version of this determination because Schedule C to the Voluntary Removal Agreement contains an agreement of what should be publicised.

Order

It follows from these findings that the Panel agrees to the voluntary removal of the Registrant’s name from the HCPC Register. The Panel Chair will sign the necessary consent.

 

Notes

The Panel granted the application to remove the Registrant from the HCPC Register.
