Allegation

1. Failed to identify and/or report clinical/safeguarding issues for the following patients, in that:

a) On 09 May 2015, Patient 2 informed you of discomfort in the breast tissue and you failed to inform other members of the Multi-Disciplinary Team (MDT);
b) On 25 April 2016, you did not inform your colleagues during the ward round that Patient 2 felt as though she was relapsing;
c) On 12 January 2016, Patient 4 said that “he wish he taken the opportunity yesterday with his few hours of freedom to kill himself” or words to that effect and you did not report this statement to the MDT;
d) On 11 April 2016, Patient 3 you were aware of Patient 3’s suicide attempts and you did not escalate or report this concern to the MDT;
e) On 14 April 2016, you treated Patient 1 alone in his bedroom.

2. Failed to maintain adequate records, in that:

a) On 21 April 2016, Patient 2 informed you that “she felt as though she was relapsing” and you did not document that you handed it over to MDT;

b) On 20 April 2016, you attended to Patient 2 but did not write up the notes until 25 April 2016;

3. Failed to provide patients with adequate care and treatment, specifically in relation to the following patients:

a) Patient 1, you did not assess or identify the reason for the pain:

i) On 27 January 2016, pain in his groin;

ii) On 01 February 2016, pain in his feet and stretches on different muscle groups;

iii) On 15 February 2016, he flinched and advised sharp pains in medial aspect of thigh;

iv) On 17 February 2016, pain in the feet and residual pain through the hip and into the back;

v) On 18 February 2016, sharp pain in the left lateral side and difficulty in standing;

vi) On 25 February 2016, pain in the groin area and in the right arm biceps;

vii) On 29 February 2016, pain in the:

i) arm which had precipitated his attack;

ii) left side of the groin and lower back;

iii) groin with the rotation movements of the knees in lying.

viii) On 9 March 2016, pain in his Achilles tendon on his left leg;

ix) On 11 April 2016, the patient reported the following:

i) his legs felt trembly on the hovercraft;

ii) pain in his groin;

iii) discomfort in lower back and calves;

iv) feet sometimes claw.

b) Patient 1, you did not provide appropriate physiotherapy intervention when you observed or were advised of the following:

i) On 27 January 2016, pain in his groin;

ii) On 01 February 2016, pain in his feet and stretches on different
muscle groups;

iii) On 15 February 2016, he flinched and advised sharp pains in
medial aspect of thigh;

iv) On 17 February 2016, pain in the feet and residual pain through
the hip and into the back;

v) On 18 February 2016, sharp pain in the left lateral side and
difficulty in standing;

vi) On 25 February 2016, pain in the groin area and in the right arm biceps;

vii) On 29 February 2016, pain in the:

i) arm which had precipitated his attack;

ii) left side of the groin and lower back;

iii) groin with the rotation movements of the knees in lying.

viii) On 9 March 2016, pain in his Achilles tendon on his left leg;

ix) On 11 April 2016, the patient reported the following:

i) his legs felt trembly on the hovercraft;

ii) pain in his groin;

iii) discomfort in lower back and calves;

iv) feet sometimes claw.

c) Patient 1, you did not provide management advice, when you
observed or were advised of the following:

i) On 27 January 2016, pain in his groin;

ii) On 01 February 2016, pain in his feet and stretches on different
muscle groups;

iii) On 15 February 2016, he flinched and advised sharp pains in
medial aspect of thigh;

iv) On 17 February 2016, pain in the feet and residual pain through
the hip and into the back;

v) On 18 February 2016, sharp pain in the left lateral side and

vi) On 25 February 2016, pain in the groin area and in the right arm biceps;

vii) On 29 February 2016, pain in the:

d) Patient 1, you did not escalate issues to other members of the MDT when you observed or were advised of the following:

i) On 14 March 2016, pain down her neck and back of her shoulders when she eats;

ii) On 01 April 2016, pain in the shoulders;

iii) On 25 April 2016, sharp pains in the wrist and elbow;

iv) On 25 April 2016, pain in top part of upper left side of shoulder and rib cage;

f) Patient 2, you did not provide physiotherapy intervention when you observed or were advised of the following:

i) On 14 March 2016, pain down her neck and back of her shoulders when she eats;

ii) On 01 April 2016, pain in the shoulders;

iii) On 25 April 2016, sharp pains in the wrist and elbow;

iv) On 25 April 2016, pain in top part of upper left side of shoulder and rib cage;

g) Patient 2, you did not provide management advice, when you observed or were advised of the following:

i) On 14 March 2016, pain down her neck and back of her shoulders when she eats;

ii) On 01 April 2016, pain in the shoulders;

iii) On 25 April 2016, sharp pains in the wrist and elbow;

iv) On 25 April 2016, pain in top part of upper left side of shoulder and rib cage;

h) Patient 2, you did not escalate issues to other members of the MDT when you observed or were advised of the following:

i) On 14 March 2016, pain down her neck and back of her shoulders when she eats;

ii) On 01 April 2016, pain in the shoulders;

iii) On 25 April 2016, sharp pains in the wrist and elbow;

iv) On 25 April 2016, pain in top part of upper left side of shoulder and rib cage;

i) Patient 1, you did not follow the seizure care plan, when you observed the patient experiencing seizure like symptoms on the following dates:

i) 08 February 2016;
ii) 25 February 2016;
iii) 14 March 2016.

j) Patient 1, you did not complete a falls risk assessment and management plan when you became aware of the patient’s fall on:

i) 11 February 2017; and
ii) 09 March 2016.

4. Between 08 February 2016 and 14 March 2016, you continued to treat Patient 1 when he experienced seizure activities which was inappropriate.

5. Did not provide clear clinical reasoning and/or rationale for your physiotherapy intervention, in that:

a) On 09 May 2015, you massaged Patient 2’s breast tissue to relieve pain.

6. Your actions described at particulars 1(a) to 5(a) constitute misconduct and/or lack of competence.

7. By reason of your misconduct and/or lack of competence, your fitness to practise is impaired.
