Allegation

Whilst employed as a registered Physiotherapist with the Children’s Trust (‘the Trust’):

1. In relation to Child A, between August 2016 and March 2017, you:

(a) Did not ensure that Child A’s leg brace was removed following medical opinion which recommended that it should be removed and / or did not adequately follow up on your concerns regarding removing the leg brace;

(b) Did not adequately record your clinical reasoning for your decision to keep Child A’s leg brace on;

(c) Did not obtain and / or record informed consent in relation to your decision to keep Child A’s leg brace on.

2. In relation to Child B, between January 2011 and March 2017, you:

(a) Continued to carry out a movement programme with Child B despite:

(i) there being no clinical benefit for Child B;

(ii) Child B being at risk of fracture.

(b) Did not adequately record a risk assessment and / or your clinical reasoning for continuing with complete and / or record a risk assessment of the movement programme;

(c) Did not follow medical advice that Child B should be fitted for a moulded seat;

(d) Did not discuss obtaining a new spinal jacket for Child B with your colleagues and / or record your clinical reasoning for obtaining a new spinal jacket for Child B record and / or obtain informed consent with respect to a new spinal jacket;

(e) Did not follow medical advice ensure that Child B’s splints were should be discontinued despite medical opinion that Child B’s feet were no longer the correct shape to tolerate the splints;

(f) Did not discuss and / or record discussion with the medical team regarding your decision to keep Child B’s splints on;

(g) Did not complete and / or record a risk assessment of Child B’s splints;

(h) Advised that Child B should continue standing for health reasons despite there being no clinical benefit for Child B;

(i) Did not complete and / or record a risk assessment in relation to Child B’s standing.

3. The matters as set out in paragraphs 1 – 2 constitutes misconduct.

4. By reason of your misconduct and / or lack of competence, your fitness to practise is impaired.
