ORDER: The Registrar is directed to annotate the Register to show that, for a period of 18 months from the date that this Order comes into effect, you, Mrs Sally Bayliss, must comply with the following conditions of practice when working as a Physiotherapist:
1.You must not carry out any private practice work.
2.Except in life threatening emergencies, you must not be involved in the direct provision of services without a chaperone being present. The chaperone is to be appointed by your line manager. The name and professional title of the chaperone is to be provided to the HCPC by the Registrant as soon as practicable.
3.You must maintain a record of:
• Every case where you have been involved in the direct provision of services, in each case signed by the chaperone; and
• Every case where you have been involved in the direct provision of services to such service users in life threatening emergencies and without a chaperone being present.
4.You must provide a copy of these records to the HCPC on a monthly basis. A copy of the monthly reports to be provided 14 days before the date of the next review hearing, or alternatively, confirm that there have been no such cases during that period. You must make these records available for inspection at all reasonable times by any person authorised to act on behalf of the HCPC.
5.You must promptly inform the HCPC if you cease to be employed by your current employer or take up any other or further employment.
6.You must promptly inform the HCPC of any disciplinary proceedings taken against you by your employer.
7.You must inform the following parties that your registration is subject to these conditions:
A.any organisation or person employing or contracting with you to undertake professional work;
B.any agency you are registered with or apply to be registered with (at the time of application); and
C.any prospective employer (at the time of your application).
This Order will be reviewed by 10 March 2021.
Right to Apply to the Court:
Under Article 31(12) of the Health and Social Work Professions Order 2001, you may apply to the appropriate court to terminate the order.
European alert mechanism:
In accordance with Regulation 67 of the European Union (Recognition of Professional Qualifications) Regulations 2015, the HCPC will inform the competent authorities in all other EEA States that your right to practise has been restricted.
You may appeal to the County Court against the HCPC’s decision to do so. Any appeal must be made within 28 days of the date when this notice is served on you. This right of appeal is separate from your right to appeal against the decision and order of the Panel.
