Finding

Preliminary Matters
1. The Panel was originally scheduled to conduct the final hearing of the HCPC’s allegation made against the Registrant, Ms Katie Davis, a Paramedic. The hearing was listed to take place over three days commencing today. On Thursday, 1 December 2022, the Panel was informed that the HCPC had reached an agreement with the Registrant as to the proposed disposal of the case, and that instead of conducting a contested hearing over three days, the Panel would be asked to consider a Consent Application with the listing of the case reduced to one day.

2. The Consent Application is that the Panel should agree to the mutual application of the HCPC and the Registrant that the latter’s registration should be subject to a suspension order for a period of 12 months.

Notice of hearing
3. The Panel was satisfied that the email dated 31 October 2022 sent to the Registrant informing her of the date, time and manner in which the hearing was to be conducted, constituted good service of the notice of hearing.

Proceeding in the absence of the Registrant
4. The Presenting Officer applied for a direction that the hearing should proceed in the absence of the Registrant. In considering this application the Panel had regard to the factors identified in the relevant HCPTS Practice Note and accepted the advice of the Legal Assessor. After careful consideration the Panel agreed that the hearing should proceed. The reasons for this decision were as follows:
• The Registrant and her Solicitor had knowledge of the hearing date and also knew that they could have attended the hearing had they wished to do so.
• In fact, for reasons the Panel understood, neither the Registrant nor her Solicitor wished to attend the hearing. The latter communicated this decision in an email dated 30 November 2022.
• There was no suggestion that the Registrant wished the present hearing to be adjourned or that either she or her Solicitor would wish to attend the hearing were it to be conducted at a later date.
• The Panel accepted that the relevant input by and on behalf of the Registrant had been made in writing in advance of the hearing (the relevant documents will be described below); in reality there was no meaningful contribution that could have been made at the present hearing by oral submissions or further evidence.
• For these reasons the Panel concluded that there were no reasons not to proceed with the hearing today, and good reasons why the issue should be resolved as soon as possible.

Conducting the hearing in private
5. The Panel is sitting as the Health Committee and the allegation is one that the Registrant’s fitness to practise is impaired by reason of her health. In these circumstances, the Panel agreed that the hearing should be conducted wholly in private in order to protect the Registrant’s private life. Similarly, this written determination should be treated as private.

Order

The Registrar is directed to suspend the registration of Ms Katie Davis or a period of 12 months with immediate effect.

Right of Appeal
You may appeal to the High Court in England and Wales against the Panel’s decision and the order it has made against you.

Under Article 29(10) of the Health Professions Order 2001, any appeal must be made within 28 days of the date when this notice is served on you. The Panel’s order will not take effect until the appeal period has expired or, if you appeal, until that appeal is disposed of or withdrawn.
