Allegation

As a registered Practitioner Psychologist (PYL15231) your fitness to practise is impaired by reason of misconduct. In that:

 

1. On or before 30 August 2017, you bullied and/or harassed Colleague 6 in that you:

 

a) contacted Colleague 6 on several occasions during her non-working hours

 

b) On or around 30 August 2017, you:

 

i. sent her an email at 22:08 hours stating “I am trying to ring you” or words to that effect;

 

ii. sent at least two text messages to Colleague 6 regarding work when she was at her uncle’s funeral; and

 

iii. called Colleague 6 chasing work when she was at her uncle’s funeral.

 

c) requested Colleague 6 to do work when she was on annual leave;

 

e) undermined Colleague 6’s authority and/or were aggressive towards Colleague 6, in that you interrupted Colleague 6’s supervision session with a junior member of staff and started questioning Colleague 6 on the status of a situation;

 

f) displayed unprofessional behaviour towards and/or made inappropriate comments to Colleague 6 as set out in Schedule A.

 

2. Between April 2016 and December 2017, you bullied and/or harassed Colleague 8 in that you:

 

a) On or around 08 November 2017:

 

i) talked over her on several occasions and/or argued with Colleague 8.

 

iii) asked Colleague 8 to leave the room when she was required to stay in the room;

 

b) asked Colleague 8 to come to work when she was unwell;

 

c) contacted Colleague 8 during her non-working hours;

 

d) made inappropriate comments to Colleague 8 and/or displayed unprofessional behaviour towards Colleague 8 as set out in Schedule B.

 

3. Between April 2016 and December 2017, you bullied and/or harassed Colleague 9, in that:

 

a) when you called Colleague 9 and she was not available, you asked her colleagues on several occasions to fetch her from the toilet;

 

b) you displayed unprofessional behaviour and/or made inappropriate comments to Colleague 9 as set out in Schedule C.

 

4. Between April 2015 and December 2017, you:

 

a) displayed unprofessional behaviour in that you used foul and/or threatening language in the presence of the administrative staff; and

 

b) displayed unprofessional behaviour and/or made inappropriate comments to colleagues and/or people who did not answer the phone when you called or who had not given work back to you at the time you suggested as set out in Schedule D.

 

5. Between August 2016 and December 2016, you bullied and/or harassed Colleague 5, in that:

 

a) when you called Colleague 5 and/or required her when she was not available you asked her colleagues on several occasions to fetch her from the toilet and ask her to come and take your call;

 

b) displayed unprofessional behaviour and/or made inappropriate comments to Colleague 5 as set out in Schedule E.

 

6. Between May 2015 and 06 December 2017, you bullied and/or harassed, Colleague 1 in that you contacted her on several occasions during her non-working hours.

 

7. Between December 2014 and December 2017, you bullied and/or harassed Colleague 7, in that you called him during his non-working hours.

 

8. Between April 2015 and December 2017, you bullied and/or harassed Colleague 10, in that:

 

a) you stood over Colleague 10 until she completed a task;

 

b) when you called Colleague 10 and/or required her when she was not available you asked her colleagues on several occasions to fetch her from the toilet and ask her to come and take your call;

 

c) displayed unprofessional behaviour and/or made inappropriate comments to Colleague 10 as set out in Schedule F.

 

9. Between April 2015 and December 2017, you were rude and/or aggressive towards Colleague 12, in that you said to Colleague 12 “what the **** have you been doing for 12 months” or words to that effect.

 

10. The matters set out in particulars 1 to 9 constitute misconduct.

 

11. By reason of your misconduct, your fitness to practise is impaired.

 

Schedule A:

 

You said:

 

1. “stop, stop sending that silly email, what are you doing?” or words to that effect;

 

2. “what is that silly meeting” or words to that effect;

 

3. “you are talking to me like him now” and him referred to a man who was rambling;

 

4. “if you can’t herd them, then I will” or words to that effect;

 

5. “you are being like those *******" or words to that effect;

 

Schedule B:

 

You said:

 

1. “you had better be at that meeting or I will kill you” or words to that effect;

 

2. “it is not your job to do training and I am not interested in what Colleague 28 wanted” or words to that effect;

 

3. “don’t tell me you have not got them” or words to that effect;

 

4. “get down to them wards and get the reports now” or words to that effect;

 

5. you referred to Colleague 39 as “the whally” in the presence of Colleague 8 and/or other colleagues;

 

6. you referred to Colleague 8 as “raging ****” and/or “lazy *****”.

 

Schedule C:

 

1) On or around 05 June 2017, you made an inappropriate remark to Colleague 9 about Colleague 32, in that you said “Colleague 32 is a ******* bastard when I get my hands on them you will hear him scream from your office”, or words to that effect;

 

2) On or around 19 June 2017, you said to Colleague 9 “never you speak about the previous Director of Operations again as he should have been ******* sacked years ago” or words to that effect;

 

3) you referred to Colleagues 33 and 34 as “numpty” in the presence of Colleague 9; and

 

4) On or around 13 September 2017, you said to Colleague 9 that Colleague 35 is a “namby pamby sitting with her clean nails and she needs to get some ****** work done” or words to that effect.

 

5) told Colleague 9 on several occasions, “you are no good to me” or words to that effect;

 

6) shouted at Colleague 9 on several occasions, especially when you wanted something done;

 

7) On or around 02 November 2017, you told Colleague 9:

 

a) “every time you open your mouth you cause me problems” or words to that effect; and

 

b) “I can’t cope with you anymore” or words to that effect;

 

c) “shut up you’re not listening to me” or words to that effect:

 

d) referred to Colleague 9 as “that pip-squeak one” and/or “that one over there” or words to that effect to her colleagues; and

 

e) that the Exec PA’s “are useless, can’t do anything” or words to that effect.

 

Schedule D:

 

You said:

 

1) “lazy ******” and/or “lazy ******” or words to that effect;

 

2) “I’ll kill the *******” or words to that effect; and

 

3) “lazy ********” or words to that effect.

 

Schedule E:

 

You said:

 

1) “if anyone takes you off your ******* job I’ll ******* kill them” or words to that effect;

 

2) “if you don’t get this done, I will ******* kill you” or words to that effect; and

 

3) you referred to Colleague 5 as “Mrs Crazy Chops” or words to that effect.

 

Schedule F:

 

You:

 

1) referred to Colleague 10 as “Mrs Crazy Chops” or words to that effect;

 

2) on several occasions you knocked Colleague 10’s hands off the keyboard when she was not typing quick enough for you;

 

3) you said “you ******* well will be, I need you here” or words to that effect;

 

4) you pushed Colleague 10 out of your office, specifically you placed your hands on Colleague 10’s shoulders and pushed her backwards;

 

5) you told Colleague 10 that Colleague 38 was “*******useless and she should go through me in the future” or words to that effect;

 

6) you told Colleague 10 “get that one” and/or “get that lazy ******” and/or “lazy *******”;

 

7) sent a text message to Colleague 10 stating “get the **** out of that meeting I need to speak to you now” or words to that effect;

 

8) told Colleague 10 “if you don’t do this I will ******* kill you” or words to that effect;

 

9) told Colleague 10 that it was a “waste for space that she carried out her Record Keeper duties” or words to that effect; and

 

10) you told Colleague 10 “just ******* get it in, I don’t care what *******

box it goes in” or words to that effect; and

 

11) you shouted at Colleague 10 “type quicker” or words to that effect.
