Preliminary Matters
Service
1. The Panel was satisfied by the documents in the service bundle that the Registrant was properly served with notice of this hearing by an email dated 10 March 2023 in accordance with the Rules.
Hearing in private
2. Mr D’Alton made an application for the whole of the hearing to be heard in private because the entirety of the matter relates to the Registrant’s health.
3. The Panel accepted the advice of the Legal Assessor and applied the guidance in the HCPTS Practice Note “Conducting Hearings in Private”. The Panel has the discretion to hear all or part of the hearing in private under Rule 10(1)(a) of the Health and Care Professions Council (Health Committee)(Procedure) Rules 2003 (“the Rules”).
4. The Panel decided that it was appropriate to hear the case entirely in private because the Registrant’s health is at the core of all the matters in the case. The public interest in open justice was outweighed in this case by the need to protect the Registrant’s private life.
Decision on Application
5. The Panel identified no persuasive public interest reasons why this case should proceed to a Final Hearing rather than being disposed of at this stage by a Voluntary Removal Agreement. It considered that a fully informed member of the public would consider that the proposed Voluntary Removal Agreement was an appropriate and proportionate disposal of the case. The Allegation relates solely to the Registrant’s health and the Panel considered that the proposed Voluntary Removal Agreement was sufficient regulatory response to maintain public confidence in the profession.
6. The Panel therefore agreed to the proposed Voluntary Removal Agreement.
Order
ORDER: The Registrar is directed to remove the name of Mrs Sarah G. Haynes from the Register with immediate effect.
