1. On or about 10 November 2023, you were convicted at the District Court of New South Wales, Australia, of one or more of the criminal offences as detailed in Schedule A.
2. By reason of the matter set out above at particular 1, your fitness to practise is impaired by reason of conviction.

Finding
Preliminary Matters
Application for a private hearing
1. On behalf of the HCPC, Mr Khan applied for the entire hearing to be conducted in private.
2. The case concerns criminal proceedings in Australia that are subject to a non-publication order pursuant to the Children (Criminal Proceedings) Act 1987 Australia, as the Registrant and his victim (“Person A”) were under the age of 18 at the time the offences took place.
3. The HCPC submitted that it was necessary, in order to protect the private lives of the Registrant and Person A, for the entire hearing to take place in private and that it was in the interests of justice to ensure neither individual was prejudiced by the case being heard in public. The Registrant supported that application.
4. The Panel had regard to the HCPTS Practice Note on “Conducting Hearings in Private” and accepted the advice of the Legal Assessor. The Panel granted the application for the entire hearing to be conducted in private on the grounds advanced by Mr Khan.
Order
That the Registrar is directed to suspend the registration of Mr Daniel Banfield for a period of 10 months from the date this Order comes into effect.
Notes
This order will be reviewed again before its expiry.
Interim Order
1. The Panel makes an Interim Suspension Order under Article 31(2) of the Health Professions Order 2001, the same being in the public interest, having regard to the Panel’s findings of fact and determination as to impairment and sanction.
2. This order will expire: (if no appeal is made against the Panel’s decision and order) upon the expiry of the period during which such an appeal could be made; (if an appeal is made against the Panel’s decision and order) the final determination of that appeal. This Interim Suspension Order is for a period of 18 months.
