Preliminary matters

Public/Private hearing

1. Pursuant to Rule 10(1)(a) of the Health and Care Professions Council (Health Committee) (Procedure) Rules 2003 (the Rules), hearings are held in public. However, the Rule also provides that the Panel may sit in private, wholly or partly, where it is satisfied that for the protection of the private life of the Registrant it is so required. The HCPC applied to the Panel to exercise its discretion to sit in private for the whole of the hearing, as this is a case that wholly revolves around the issue of the Registrant’s health. This application was supported by the Registrant’s Representative.

2. The Panel noted that the Allegation and the substantive Suspension Order originated from issues related entirely to the Registrant’s health. The Panel sought and accepted the Legal Assessor’s advice on the circumstances in which it may exercise its discretion to hear this matter in private. She advised that the right to a private life emanated from the terms of the European Convention of Human Rights, which were then enshrined in the terms of the UK’s Human Rights Act. It was a matter for the Panel to consider whether the Registrant’s right to a private life outweighed the public interest in this matter being heard in open session.

3. The Panel was satisfied that, in all the circumstances, the protection of the Registrant’s private life did outweigh the need for a public hearing. It decided to sit wholly in private for the hearing, as the issues of health were intrinsically linked with all aspects of the Panel’s process today. As such, this is a redacted version of the Panel’s full decision.

ORDER: The Registrar is directed to suspend Miss Ruby-May Addy for a further period of six months starting on the date of the current period of suspension.

Notes

The Order imposed today will apply from 16 December 2025.

This Order will be reviewed again before its expiry on 16 June 2026.
