Finding

Preliminary and Procedural Matters

Hearing in private

1. On behalf of the HCPC, Mr Ive made an application for the entire hearing to be heard in private to protect the private life of the Registrant. He submitted that the case involves a health allegation and that the matters in the case are inextricably linked to the Registrant’s health.

2. The Registrant confirmed that she supported this application.

3. The Panel accepted the advice of the Legal Assessor and it had regard to the guidance in the HCPTS Practice Note ‘Conducting Hearings in Private’. Having reviewed the material in the bundle the Panel considered that all the matters were linked to the Registrant’s health. In these circumstances, the Panel considered that the protection of the Registrant’s private life outweighed the public interest in open justice. It therefore agreed to the application that the entire hearing should be heard in private.


Decision

4. The Panel therefore decided to impose a Conditions of Practice Order for a period of 18 months as the most appropriate and proportionate Order.

ORDER: The Registrar is directed to annotate the HCPC Register to show that, for a period of 18 months from the date that this Order comes into effect (“the Operative Date”), you, Ms Kudzai Danielle Makedenge must comply with the following conditions of practice:

4. You must inform the HCPC within 7 days if you cease to be employed by your current employer.

5. You must inform the HCPC within 7 days if you take up other or further professional work.

6. You must inform the HCPC within 7 days if you take up work requiring registration with a professional body outside the United Kingdom.

7. You must inform the HCPC within 7 days of returning to practice in the United Kingdom.

8. You must inform the HCPC within 7 days of becoming aware of:

A. Any patient safety incident you are involved in;

B. Any investigation started against you;

C. Any disciplinary proceedings taken against you.

9. You must inform the following parties that your registration is subject to these conditions:

A. Any organisation or person employing or contracting with you to undertake professional work;

B. Any agency you are registered with or apply to be registered with to undertake professional work (at the time of application);

C. Any prospective employer for professional work (at the time of your application);

Notes

Interim Order

1. The Panel makes an Interim Conditions of Practice Order under Article 31(2) of the Health Professions Order 2001, the same being necessary to protect members of the public and being otherwise in the public interest.

2. This Order will expire: (if no appeal is made against the Panel’s decision and Order) upon the expiry of the period during which such an appeal could be made; (if an appeal is made against the Panel’s decision and Order) the final determination of that appeal, subject to a maximum period of 18 months.

1. The Panel exercised its power under Regulation 4(1) of the Health and care Professions Council (Health Committee)(Procedure) Rules 2003 to transfer the case to the Conduct and Competence Committee for full consideration.
