Order

ORDER: The Registrar is directed to impose the following conditions on the registration of Ms Martina McToal for the remainder of the period of the Order (namely until 3 April 2026).

 

1.           You must confine your professional practice to one employer in a permanent physiotherapy post.

2.           You must not practise in a self-employed capacity or through any other arrangement. This includes, but is not limited to, agency, locum or bank work.

3.           You must inform the HCPC within seven days of accepting any employment position, providing the name and address of the employer.

4.           You must inform the HCPC within seven days if you cease to be employed by any employer.

5.           You must inform the HCPC within seven days if you take up work requiring registration with a professional body outside the United Kingdom.

6.           You must inform the HCPC within seven days if you become aware of:

a. any patient safety incident you are involved in;

b. any investigation started against you; or

c. any disciplinary or capability proceedings taken against you.

7.           You must register with your employer’s occupational health service, if one is available.

8.           You must disclose the following information, as soon as reasonably practicable, to any employer or potential employer and to their occupational health service (if one is available.):

a. your health diagnosis;

b. a copy of Dr G’s report dated 29 August 2025; and

c. a copy of these interim conditions of practice.

9.           You must place yourself, and remain, under the indirect supervision of a workplace supervisor. You must meet with that supervisor as required and follow their advice and recommendations. Your supervisor must:

a.  be registered with the HCPC or another appropriate statutory regulator; and

b. be in a more senior band, grade or position than your appointed post.

10.       You must provide the HCPC with the name and contact details of your workplace supervisor, including any changes, within seven days of their appointment.

11.       You must remain under the care of the following clinicians, inform them of these conditions, and authorise them to provide the HCPC with information about your health and any treatment you are receiving:

a.     your general practitioner;

b.    [redacted]; and

c. [redacted]

12.       You must provide progress reports from any of the clinicians identified in your care to the HCPC no later than 14 days before each interim order review hearing. These reports must include information on:

a.     compliance with treatment and prescribed medication;

b.    current medication; and

c. prognosis.

13.       You must allow the HCPC to share details, as necessary, about your performance, compliance with, and/or progress under these conditions with:

a.     your employer (including its occupational health service, if one is available);

b.    any prospective employer (including its occupational health service, if one is available); and

c. the clinicians identified earlier (general practitioner, [redacted]).

14.       You must keep your professional commitments under review and limit your practice in accordance with the advice you receive from your treating clinicians.

15.       You must cease practising immediately if you are advised to do so by any clinician and must inform the HCPC within seven days of receiving such advice.

This Order will be reviewed by the Committee no later than 4 December 2025, or earlier if new evidence which is relevant to the Order becomes available after it was made.
