Order

The Registrar is directed to annotate the HCPC Register to show that for a period of 18 months from the date of this Order you, Paul A Smith, must comply with the following Interim Conditions of Practice:

1)    You must confine your professional practice to providing professional Physiotherapy services within your company practice entitled Alan Smith and Paul Smith Physiotherapy Limited (based in Rotherham) to male service users and only whilst your named supervisor (detailed in condition 4), who must be HCPC registered, is on the premises at the same time.

2)    You must maintain a record of every case where you have undertaken provision of professional services to male service users, and you must: 

A.    provide a copy of those records to the HCPC on a monthly basis, the first report to be provided within 28 days of the date of this Order, or confirm that there have been no such services provided during that period; 

B.    make those records available for inspection at all reasonable times by any person authorised to act on behalf of the HCPC; and 

C.    ensure that the records comply with the following requirements: 

i.    the records provide the dates and times on which you have undertaken the provision of Physiotherapy services; 

ii.    the records are signed by your named supervisor for each individual entry/each day/before submission to the HCPC; and

iii.    a declaration signed by you and your supervisor that only male service users have been treated by you and that this was done on the premises (mentioned in condition 1) and while the supervisor (stipulated at condition 1) was on the premises. 

3)    You must not carry out visits to a service user’s private residence. 

4)    You must place yourself and remain under the indirect supervision of a supervisor registered by the HCPC and supply details of your supervisor to the HCPC within 14 days of the Order. You must attend upon that supervisor as required and follow their advice and recommendations. Such supervision may not be carried out online. 

5)    You must inform the HCPC within 7 days if you cease to be employed by your current employer, which in this instance is your company of Alan Smith and Paul Smith Physiotherapy Limited (based in Rotherham). 

6)    You must inform the HCPC within 7 days if you take up any other or further professional work. 

7)    You must inform the HCPC within 7 days if you take up work requiring registration with a professional body outside the United Kingdom.

8)    You must inform the HCPC within 7 days of returning to practice in the United Kingdom. 

9)    You must inform the HCPC within 7 days of becoming aware of: 

A.    any patient safety incident you are involved in; 
B.    any investigation started against you; and 
C.    any disciplinary proceedings taken against you

10)    You must inform any organisation through which you are undertaking professional training that your registration is subject to these conditions.

11)    You must allow the HCPC to share, as necessary, details about your performance, compliance with, and/or progress under these conditions with any organisation through which you are undertaking professional training. 

Notes

This order will be reviewed by the Committee no later than 10 October 2026 or earlier if new evidence which is relevant to the Order becomes available after it was made.
