Allegation
As a registered occupational therapist (OT):
1. On 5 September 2023, you knowingly worked beyond your scope of practice in that you:
a. carried out speech and language therapy exercises with Patient A.
b. gave advice on speech and language therapy interventions to Patient A.
2. On 6 September 2023, you did not communicate professionally with Colleague A in that you said:
a. “you Scots, you elected a Muslim as your head”, or words to that effect
b. “a Muslim for god’s sakes”, or words to that effect.
3. On 7 September 2023, you did not communicate professionally with Patient C in relation to their injury, in that you said that Patient C “must have been careless”, or words to that effect.
4. On 8 September 2023, you:
a. did not provide adequate treatment to Patient D, in that you:
i. refused to do a personal care assessment for Patient D because she was a woman.
ii. asked a nursing colleague to do Patient D’s personal care assessment.
b. prioritised a patient assessment for Patient F over patient assessments for Patient D and/or E when this was not clinically justified.
5. On 11 September 2023, you prioritised a patient visit to Patient F instead of Patient G when this was not clinically justified.
6. On 12 September 2023, you:
a. did not communicate professionally with Colleague A in that you said:
i. “Bless”, or words to that effect.10
ii. “there is a boat out there and you could get onto it” or words to that effect.
b. did not source an appropriate sling for Patient H and/or used a sling for Patient H that was the wrong size.
c. did not submit a wheelchair request for Patient H.
7. On 13 September 2023, you:
a. did not provide adequate treatment to Patient D, in that you:
i. identified a wheeled kitchen trolley to be a suitable mobility aid for Patient D when this was not clinically justified.
ii. did not discuss the use of a kitchen trolley for Patient D with a physiotherapist.
b. attempted to order a kitchen trolley for Patient A when this was not clinically justified.
8. On or around 14 September 2023, you:
a. did not maintain accurate and complete records in that you incorrectly
recorded
i. Patient H’s height as 5’4” and/or weight as 107kg
ii. Patient H’s knee to heel measurement as 30cm
b. in relation to Patient H’s environmental assessment, did not identify the
downstairs bedroom as suitable for a discharge bed location
c. during an appointment with Patient I, did not provide appropriate treatment, in
that you:
i. focused on reach and grasp instead of active release.
ii. did not consider the use of compression gloves.
9. Between 8 January 2024 and 14 February 2024, you did not maintain adequate,
accurate and/or complete records in relation to the patients set out in Schedule A:
10. The matters set out in particulars 1 to 9 constitute misconduct
11. The matters set out in Particulars 4b), 5, 7, 8 and 9 constitute a lack of competence.
12. By reason of the matters set out above, your fitness to practise is impaired by reason of misconduct and/or lack of competence.
