Order
ORDER : the Registrar is directed to annotate the HCPC Register to show that for a period of 18 months from the date this order takes effect (“the Operative Date”), you, Barry Falk, must comply with the following conditions of practice:
1. You must confine your professional practice to providing services to users over the age of 25 years.
2. You must place yourself and remain under the indirect supervision of another HCPC registered Art Therapist and supply details of your supervisor to the HCPC 14 days of the Operative Date. You must attend upon that supervisor as required and follow their advice and recommendations.
3. You must work with your appointed HCPC registered Art Therapist supervisor to formulate a Personal Development Plan to address the following areas:
Record Keeping
Professional Boundaries
Communication
4. Within 3 months of the Operative Date, you must forward a copy of your Personal Development Plan to the HCPC.
5. You must:
a. meet with your supervisor at least once each calendar month to consider your progress towards achieving the aims set out in your Personal Development Plan;
b. follow the advice and recommendations of your supervisor;
c. allow your supervisor to provide information to the HCPC about your progress towards achieving the aims set out in your Personal Development Plan;
6. You must arrange for your supervisor to provide a report to the HCPC about your progress towards achieving the aims set out in your personal development plan and your compliance with these conditions within 3 months of the Operative Date and every three months thereafter.
7. You must inform the HCPC within seven days if you take up any or further professional work as an Art Therapist.
8. You must inform the HCPC within 7 days if you take up work requiring registration with a professional body outside the United Kingdom.
9. You must inform the HCPC within 7 days of returning to practice in the United Kingdom.
10. You must inform the HCPC within seven days of becoming aware of:
a. any patient safety incident you are involved in;
b. any investigation started against you; and
c. any disciplinary proceedings taken against you.
11. You must inform the following parties that your registration is subject to these conditions:
a. any organisation or person employing or contracting with you to undertake professional work;
b. any agency you are registered with or apply to be registered with to undertake professional work (at the time of application);
c. any prospective employer for professional work (at the time of your application);
e. any supervisor required by these conditions.
12. You must allow the HCPC to share, as necessary, details about your performance, compliance with, and / or progress under these conditions with:
a. any organisation or person employing or contracting with you to undertake professional work;
b. any agency you are registered with or apply to be registered with to undertake professional work (at the time of application);
c. any prospective employer for professional work (at the time of your application);
13. You will be responsible for meeting any and all costs associated with complying with these conditions.
14. Any condition requiring you to provide information to the HCPC is to be met by you sending the information to the offices of the HCPC, marked for the attention of the relevant case manager.
Notes
This order will be reviewed by the Committee no later than 29 July 2026 or earlier if new evidence which is relevant to the Order becomes available after it was made.
Right to Apply to the Court
Under Article 31(12) of the Health Professions Order 2001, you may apply to the appropriate court to terminate the order or revoke or vary any of the conditions imposed.
