Allegation

As a registered Occupational Therapist (OT086873):

  1. You declared that English was your first language on your HCPC registration application form when this was not the case.

2. Between 22 July 2022 and 21 June 2023, you were not able to communicate in English to the required standard for an Occupational Therapist, in that:

a. On one or more occasions, you reported that you were unable to understand what service users had said.

b. On one or more occasions, you were not able to accurately summarise information provided by service users.

c. On one or more occasions, you were unable to convey information to service users in a way they could understand.

d. On one or more occasions, you were unable to understand instruction from senior colleagues.

e. You did not attain the minimum required level on International English Language Testing System (IELTS) assessments and/or equivalent assessments.

3. You did not mobilise service users in a safe and effective manner, in that:

a. On 27 April 2023, you mobilised Service User A, who had an open wound to their heel.

b. On 23 May 2023, you mobilised Service User B, who required two members of staff to safely mobilise.

c. On an unknown date, you did not take action to prevent Service User C from falling.

4. Your conduct in relation to particular 1 was dishonest because you knew that English was not your first language when you made the declaration.

5. The matters set out in particulars 1 and 4 constitute misconduct.

6. The matters set out in particulars 2 and 3 constitute misconduct and/or lack of competence.

7. By reason of the matters set out above, your fitness to practise is impaired, by reason of your misconduct and / or lack of competence.
