Allegation

As a registered Arts Therapist (AS017200):

  1. On 2 June 2023 and/or 13 June 2023 you did not attend a scheduled session with Service User C.
  2. On or after 13 June 2023 you retained payment for Service User C’s session which did not take place.
  3. On one or more occasions on or after 21 June 2023, as set out in Schedule 1, you did not communicate professionally with Person B, in that you did not respond to attempts to contact you in a timely manner or at all.
  4. Your conduct at particular 2 above was dishonest in that you knew that you had retained payment for Service User C’s session, which was not provided.
  5. On one or more occasions between 22 December 2022 and 24 May 2023, as set out in Schedule 2, you cancelled and/or postponed a scheduled session with Service User D without sufficient notice.
  6. On 6 June 2023 you did not attend a scheduled session with Service User D.
  7. On or after 6 June 2023 you retained payment for Service User D’s session which did not take place.
  8. On one or more occasions between around 10 January 2023 and 8 June 2023, as set out in Schedule 3, you did not communicate professionally with Service User D, in that you did not respond to attempts to contact you in a timely manner or at all.
  9. Your conduct at particular 7 above was dishonest in that you knew that you had retained payment for Service User D’s session, that did not take place.
  10. On or after 10 October 2023:

a.     you did not provide a summary report in relation to Service User E, and / or;

b.     you retained payment received in relation to Service User E’s summary report despite the report not having been completed and / or provided and / or; 

c.      you laughed and / or rolled your eyes at Service User E when they told you about their diagnosis assessment process.

 

  1. On 18 October 2023 you cancelled and / or postponed a scheduled session with Service User E without sufficient notice.
  2. On or after 18 October 2023 you retained payment for one or more sessions with Service User E that did not take place.
  3. Your conduct at particular 10b above was dishonest in that you knew that you had retained payment for the report which was not completed and / or provided
  4. Your conduct at particular 12 above was dishonest in that you knew you had retained payment for one or more sessions with Service User E that did not take place.
  5. On or after 2 May 2023:
    1. You did not provide a written report in relation to Service User F;
    2. You retained payment received in relation to Service User F’s written report.
  1. On one or more occasions between 12 April 2023 and 30 August 2023, as set out in Schedule 4, you cancelled and/or postponed a scheduled session with Service User F and/or Person C without sufficient notice.
  2. On one or more occasions between 6 April 2023 and 12 October 2023, as set out in Schedule 5, you did not communicate professionally with Person C and/or Person D, in that you did not respond to attempts to contact you in a timely manner or at all.
  3. On or around 4 July 2023 you did not obtain informed consent from Service User F before inviting Person D into the session.
  4. Your conduct at particular 15b above was dishonest in that you know that you retained payment for a report that was not provided.
  5. On one or more occasions between 25 July 2023 and 31 August 2023, as set out in Schedule 6, you cancelled and / or postponed a scheduled session with Service User G without sufficient notice.
  6. On or after 6 September 2023, you retained payment for one or more sessions with Service User G that did not take place.
  7. On one or more occasions between 10 August 2023 and 3 November 2023, as set out in Schedule 7, you did not communicate professionally with Service User G, in that you did not respond to attempts to contact you in a timely manner or at all.
  8. Your conduct at particular 21 above was dishonest in that you knew you had retained payment for one or more sessions with Service User G that did not take place.
  9. On or after 14 November 2023:

a.     You did not provide a written report in relation to Service User H;

b.     You retained payment received in relation to Service User H’s written report.

  1. On one or more occasions between 21 November 2023 and 28 November 2023, as set out in Schedule 8, you cancelled and/or postponed a scheduled session with Service User H without sufficient notice.
  2. On or after 28 November 2023, you retained payment for one or more sessions with Service User H which did not take place.
  3. On one or more occasions between 28 November 2023 and 4 December 2023, as set out in Schedule 9, you did not communicate professionally with Person E, in that you did not respond to attempts to contact you in a timely manner or at all.
  4. Your conduct at particular 24b above was dishonest in that you knew that you had retained payment for the report which was not provided.
  5. Your conduct at particular 26 above was dishonest in that you knew that you had retained payment for one or more sessions with Service User H that did not take place.
  6. On one or more occasions between 4 December 2023 and 11 December 2023, as set out in Schedule 10, you cancelled and/or postponed a scheduled session with Service User I without sufficient notice.
  7. On 17 January 2024, you did not attend a scheduled session with Service User I.
  8. On or after 19 January 2024, you retained payment for one or more sessions with Service User I which did not take place.
  9. On or after 12 January 2024, you did not provide a written plan in relation to Service User I.
  10. On one or more occasions between 4 December 2023 and 23 January 2024 as set out in Schedule 11, you did not communicate professionally with Person F and/or Person G, in that you did not respond to attempts to contact you in a timely manner or at all.
  11. On or around 9 January 2024, you recommended medication and/or supplements to Person F for Service User I.
  12. Between May 2023 and 18 April 2024, you advertised yourself as being a member of the British Association of Art Therapists (BAAT), when you were not a member.
  13. In respect of particular 35, you provided advice regarding medication and supplements that is beyond your scope of practice.  
  14. Your conduct at particular 32 above was dishonest in that you knew that you had retained payment for one or more sessions with Service User I that were not provided.
  15. Your conduct in relation to particular 36 was dishonest in that:

a.     you knew that you were not a member of BAAT and/or;

b.     you intended to create a false impression that you were a member of BAAT.

  1. On one or more occasions between 1 April 2024 and 27 April 2024 as set out in Schedule 12, you did not communicate professionally with Person H, in that you did not respond to their correspondence in a timely manner or at all.
  2. On or after 1 April 2024, you retained payment for one or more sessions with Service User K that did not take place.
  3. On or after 8 March 2024, while subject to an interim suspension order imposed by the Health and Care Professions Tribunal Service, you:

a.     practised as an Arts Psychotherapist and/or Arts Therapist and/or;

b.     used and/or implied that you are entitled to use the protected title Arts Psychotherapist and/or Arts Therapist.

  1. The matter set out at particular 41 above is dishonest in that you knew you had retained payment for one or more sessions that did not take place.
  2. The matter set out at particular 42 above is misleading and/or dishonest in that:

a.     you knew that you were not permitted to practise as an Arts Psychotherapist and/or Arts Therapist and/or;

b.     you knew that you were not permitted to use and/or imply that you are entitled to use a protected title whilst subject to an interim suspension order.

  1. On one or more occasions between 20 July 2023 and 30 November 2023 as set out in Schedule 13, you cancelled and/or postponed a scheduled session with Service User L without sufficient notice.
  2. On 16 August 2023, you did not attend a session with Service User L.
  3. On one or more occasions between 16 August 2023 and 27 February 2024 as set out in Schedule 14, you did not communicate professionally with Person I, in that you did not respond to their correspondence in a timely manner or at all.
  4. On or after 30 November 2023, you retained payment for one or more sessions with Service User L, that did not take place.
  5. On or after 22 July 2023:

a.     you did not provide a supporting document in relation to Service User L’s Disability Living Allowance (DLA) application, which you had agreed to provide and/or;

b.     you did not provide a proposal for Service User L’s Education, Health and Care Plan (EHCP) application, which you had agreed to provide and/or;

c.      you retained payment received in relation to a document for Service User L’s DLA application and/or EHCP application despite the document or documents not having been completed and/or provided by you. 

  1. The matter set out at particular 48 above is dishonest in that you knew you had retained payment for one or more sessions, that did not take place.
  2. The matter set out at particular 49c above is dishonest in that you knew you had retained payment for a document or documents that were not completed and/or provided by you.
  3. The matters set out at particulars 1-51 above constitute misconduct.
  4. By reason of the above matters set out above, your fitness to practise is impaired by reason of misconduct.
