Allegation

In the course of your employment as a Hearing Aid Dispenser for NuEar Hearing Care:

 

1. On or around 15 July 2014, you stated the following on written communication with Service User A:

 

a. 'Nu-Ear Hearing Care are members of the British Society of Hearing Aids Audiologist and abides by its Code of Ethics';

 

b. 'Hearing Aid Dispensers are required to be registered with the Hearing Aid Council. A copy of the Council's 'Code of Practice' may be seen on request. The Council's duties include ensuring adequate standards in Dispensers conduct and competence. Their address is Witan Court, 305 Upper Forth Street, Milton Keynes, MKS

1EH'.

 

2. On or around 15 July 2014, you attended the home of a Service User A, who is a vulnerable adult, and:

 

a. You took a monetary deposit from Service User A without a third party being present;

 

b. You did not provide Service User A with written details of the cooling off period and/or whether it applied in the circumstances;

 

c. You did not explain clearly to Service User A that the deposit was non-refundable; and/or

 

d. Your written receipt of the transaction was not clear and/or legible and/or did not contain sufficient detail, in that:

i. You did not provide clear information about the types of hearing aids supplied; and/or

ii. You used technical abbreviations without providing written explanations for these.

 

3. When you returned to the home of Service User A for a second visit, you suggested to Person C that you could obtain a full refund for Service User A, subject to keeping £200 for your own 'troubles’, or words to that effect;

 

4. The matters described in Paragraph 1 and/or 3 are:

i. inaccurate; and/or

ii. misleading; and/or

iii. dishonest.

 

5. The matters described in Paragraphs 1 and/or 3 and/or 4 constitute misconduct.

 

6. The matters described in paragraph 2 constitute misconduct and/or a lack of competence.

 

7. By reason of that misconduct and/or lack of competence, your fitness to practise is impaired.
