Allegation
As a registered Occupational Therapist (OT73350):
1. On 4 April 2022 you were issued with a Conditional Caution from Greater Manchester Police for the offence of assault by beating, in that:
a. On or about 3 April 2022 assaulted Person A by beating, contrary to section 39 of the Criminal Justice Act 1988
b. On 3 April 2022 assaulted Person B by beating, contrary to section 39 of the Criminal Justice Act 1988.
2. You did not declare the matter referred to in Particular 1 as soon as possible to:
a. HCPC
b. HMR Adult Community Services
c. Salford Care Organisation
3. Your conduct in relation to Particular 2 was dishonest and / or misleading in that you knew you were supposed to.
4. The matters set out above in Particulars 2 and/or 3 constitute misconduct.
5. By reason of the matters set out above, your fitness to practise is impaired by reason of your caution and/or misconduct.
Finding
Preliminary Matters
Application for the hearing to be held in private
1. Ms Scrivens applied for the hearing to be held in private to protect the health and / or private life of the Registrant. Dr Danti advised the Panel that the HCPC did not object to the application.
2. The Panel accepted the advice of the Legal Assessor. He referred it to the HCPTS Practice Note on “Conducting Hearings in Private”, which states that as a general rule hearings are to be heard in public in accordance with the ‘open justice’ principle. However, in certain circumstances it is in the interests of justice for the hearing to take place wholly or partially in private.
3. The Panel considered the representations made and determined that it was appropriate for the hearing to be heard entirely in private to protect the health and / or private life of the Registrant. The Panel concluded that the Registrant’s health and private life were so inextricably linked to the concerns raised that it would not be possible to conduct only part of the hearing in private.

Order
The Registrar is directed to annotate the Register to show that, for a period of 6 months from the date that this Order comes into effect (“the Operative Date”), you, Kirsty Reeves, must comply with the following conditions of practice:
Whilst working as a registered Occupational Therapist:
1. You must identify a mentor from a registered healthcare profession, senior to you, and share the decision of this substantive hearing with that mentor.
2. You must write a reflective piece on your dishonest non-disclosure and what you have learned from any training courses undertaken.
3. You must then formulate a Personal Development Plan discussed and agreed with the mentor designed to address the deficiencies in the following areas of your conduct:
• How you will, in the future, implement strategies to prevent a repetition of an act/omission which may impact on your professional career;
• How you have understood the concept of dishonesty, in particular in relation to an omission to act;
• How you will, in the future, prevent a repetition of dishonest conduct;
• What impact your dishonest non-disclosure has had or may have had in relation to colleagues, service users, the profession, and the wider public.
4. Within three months of the Operative Date, you must forward a copy of your Personal Development Plan to the HCPC.
5. You must meet with your mentor every two months to consider your progress towards achieving the aims set out in your Personal Development Plan.
6. You must allow your mentor to provide information to the HCPC about your progress towards achieving the aims set out in your Personal Development Plan.
7. Your Personal Development Plan must be signed off as complete by your mentor prior to the substantive review of this Order.
8. You must inform the following parties that your registration is subject to these conditions:
A. any organisation or person employing or contracting with you to undertake professional work;
B. any agency you are registered with or apply to be registered with to undertake professional work (at the time of application);
C. any prospective employer for professional work (at the time of your application).
9. You must allow the HCPC to share, as necessary, details about your performance, compliance with, and/or progress under these conditions with:
A. any organisation or person employing or contracting with you to undertake professional work;
B. any agency you are registered with or apply to be registered with to undertake professional work (at the time of application);
C. any prospective employer for professional work (at the time of your application).
Notes
This Order will be reviewed again before its expiry.
Interim Order
1. The Panel makes an Interim Conditions of Practice Order under Article 31(2) of the Health Professions Order 2001, the same being necessary to protect members of the public and being otherwise in the public interest.
2. This order will expire: (if no appeal is made against the Panel’s decision and Order) upon the expiry of the period during which such an appeal could be made; (if an appeal is made against the Panel’s decision and Order) the final determination of that appeal, subject to a maximum period of 18 months.
