Preliminary Matters:

Notice of Hearing

1. The Notice of Hearing was sent by email to the Registrant’s registered email address on 9 September 2020. Good service was found by the Panel.

Proceeding in Absence

2. The Panel, in this context, took particular note of the email to the HCPC from the Registrant, dated 2 September 2020, within which he wrote “neither myself or any other persons wish to attend”. Consistent with that stance, there has been no application for these proceedings to be adjourned.

3. The Panel took the view that it would be to the Registrant’s advantage for this case to proceed today. Such a course would also be in the public interest. In these circumstances and given the decision that good service has been effected, the Panel granted Mr D’Alton’s submission that it would be appropriate for this hearing to proceed in the absence of the Registrant, in accordance with the provisions of Rule 11 of the Procedure Rules.

Hearing in Private

4. Mr D’Alton submitted that the entire case should be heard in private, in accordance with Rule 10(1)(a) of the Procedure Rules, namely, to protect the private life of the Registrant. The matters to be decided upon are intrinsically linked to the state of the Registrant’s health and, therefore, this Health Committee decided it was appropriate for this application to be granted.

ORDER: The Registrar is directed to remove the name of Christopher Nugent from the Paramedic part of the HCPC Register with immediate effect.
