Mr Ian Westwood

Whilst registered as an Operating Department Practitioner with the Health and Care Professions Council and during the course of your employment with Walsall Healthcare NHS Trust, you:

1. On one or more occasions between December 2017 and April 2018, made inappropriate verbal remarks and/or gestures to Colleague A, including:
a. “you’re in denial, you’re gay, when are you going to have an affair with me?”, or words to that effect;
b. asking Colleague A when he was going to leave his wife, or words to that effect;
c. telling Colleague A that he was gay;
d. telling Colleague A you wanted to have sex with him;
e. mimicking performing oral sex on a man.

2. On or around 31 March 2018, sent inappropriate text messages to:
a. Colleague A; and/or
b. Colleague B

3. On various occasions between December 2017 and April 2018, touched Colleague A inappropriately, in that you:
a. stroked Colleague A’s neck and/or ears;
b. touched Colleague A’s genital area through his trousers;
c. touched Colleague A’s bottom;.
d. put your hand down Colleague A’s scrub trousers and/or underwear and touched his buttocks.

4. On one or more occasions on unknown dates, touched Colleague B inappropriately, in that you:
a. touched Colleague B’s bottom
b. touched Colleague B’s genital area through his trousers.

5. On one or more occasions between December 2017 and April 2018, and on unknown dates, exposed your genitals to colleagues in the work place.

6. Your conduct as described in particulars 1 - 5 was sexually motivated.

7. The matters described in particulars 1 - 6 constitute misconduct.

8. By reason of your misconduct your Fitness to Practise is impaired
