Allegation

As a registered Occupational Therapist (OT64320) your Fitness to Practise is impaired in that:

1. You have a physical and/or mental health condition as set out in Schedule A.

2. On, or around, 21 May 2020, you used words and / or phrases to others that included inappropriate language. This language included suggestions that you had planned or intended to 'stab your neighbour' and / or 'strangle your neighbour', or words to that effect.

3. The language stated in Particular 2 was inappropriate and / or amounted to threats of harm another person.

4. The matters set out in Particulars 2 and 3 amount to misconduct. 5. By reason of your health and / or misconduct, your fitness to practise is impaired.

Finding

Preliminary Matters
Proceeding in Private
1 The HCPC applied for the entirety of the hearing to be conducted in private because the allegation was inextricably linked with the Registrant’s health. The Presenting Officer submitted that the Panel had discretion to allow the application pursuant to Rule 10 of the Health and Care Professions Council (Health Committee) (Procedure) Rules 2003 (“the Rules”) and that the hearing should proceed in private to protect the private life of the Registrant.

2 The Panel had regard to the HCPTS Practice Note entitled “Conducting Hearings in Private” and the Rules to which it had been referred by the Presenting Officer. The Panel noted that there is reference to the health of the Registrant throughout the supplied documentation and that it was an apparent health event which gave rise to the misconduct aspect of the allegations. Whilst conscious that there is a presumption that fitness to practise proceedings will take place in public, the Panel was unable to identify a way by which it could protect the private life of the Registrant if the hearing proceeded in public. The Panel was satisfied that it was appropriate for the entirety of the hearing to proceed in private.

Order

The Registrar is directed to remove the name of Ms Nicola Hemple from the Register with immediate effect

You may appeal to the High Court in England and Wales against the Panel’s decision and the order it has made against you.

Under Article 29(10) of the Health Professions Order 2001, any appeal must be made within 28 days of the date when this notice is served on you.
