Allegation
As a registered Operating Department Practitioner (ODP32374) your fitness to practise is impaired by reason of your caution. In that:
1.On 21 January 2021, you were given a simple caution under:
a. S.1 Malicious Communications Act 1988 for sending indecent/offensive/threatening letter/electronic communications/other articles on 24 November 2020 and 08 December 2020.
b. S.33 Criminal Justice and Courts Act 2015 disclosing private sexual photographs and films with intent to cause distress on 24 November 2020 and 08 December 2020.
2.By reason of your caution your fitness to practice is impaired.

Preliminary Matters
Service
1. The Panel was provided with a Service Bundle, including a Notice of Hearing dated 17 September 2024 (“the Notice”) which informed the Registrant of the date, time and venue (virtual) for the hearing. The Notice had been emailed to the Registrant’s registered email address. The Registrant attended the hearing in response to the Notice. The Panel was satisfied that the Registrant had been served with Notice in accordance with the Rules.
2. The Panel noted that the Allegation as set out in the Notice of Allegation did not match that which had been referred by the Investigating Committee (“IC”). There was a reference to an extraneous matter and the Panel took this as a typographical error. The Allegation as referred by the IC is set out above.
Proceeding in private
3. Mr Ross applied to the Panel to sit in private for parts of the hearing where the interests of protecting the privacy of certain individuals outweighed the public interest in a public hearing. He identified that the relevant individuals were the complainant/victim, the Registrant and members of the Registrant’s family. He submitted that the evidence might lead to identification of the individuals by reference to them or divulge personal information.
4. The Panel accepted the legal advice that it had a discretion to sit in private in appropriate circumstances pursuant to rule 10(a)(i).
5. The Panel considered that the complainant/victim was entitled to privacy over the background matters. The Registrant’s interest in protecting information about her private family life was also engaged. The interests of justice also embraced the right to privacy of the Registrant’s family. The Panel decided that, where information about the private lives of these persons was referred to in the hearing, their rights outweighed the need for a hearing in public.
6. The Panel considered that the hearing would be very much concerned with information concerning all of the relevant individuals. The whole of the factual matrix behind the cautions involved the familial interactions. As a result, the Panel decided that it would not be practicable to hold the hearing partly in private and partly in public. The Panel decided to hold the hearing in private.
Order
Order: The Registrar is directed to impose a Caution Order on the registration of Ms Yulia Saveleva for a period of two years.
