Order

The Registrar is directed to annotate the Register on an interim basis to show that, for a period of 18 months, you, Sean C Clement, must comply with the following conditions of practice:

1. With immediate effect, you should use the “Clinico” patient software system as your primary method of communicating with all of your patients.

2. Within 7 days, you should obtain a dedicated work mobile phone which is separate to your personal mobile phone for the purpose of communicating with patients where it is not possible to do so via Clinico. You must notify the HCPC when you obtain and start to use this work mobile phone.

3. You must place yourself and remain under the indirect supervision of a workplace supervisor, registered by the HCPC. You must supply details of your prospective supervisor to the HCPC within 14 days, and obtain the approval of the HCPC of that supervisor. You must attend upon that supervisor as required and follow their advice and recommendations.

4. Within 7 days, you must create and maintain a log of all your female patients, including your method of communication with them and any treatment you have provided.

5. You must arrange for an audit of this log of your female patients by your supervisor every 14 days. You must give your supervisor access to your log of female patients and the contents of all your communication with them. The first audit is to take place within 14 days of the date of the HCPC’s approval of your supervisor as set out in condition 3.

6. You must send a copy of the results of each audit to the HCPC within 7 days of receipt.

7. Within 28 days you must satisfactorily complete a course on professional boundaries and ethics and forward a copy of your results, or evidence of completion, to the HCPC within 7 days of receiving them.

8. You must write a reflective statement considering the allegations and text messages referred to by Patient A and provide reflection upon the impact of them on Patient A, and their significance for you as a registrant and for the profession of physiotherapy. This reflective statement should be sent to the HCPC prior to the next review hearing.
