Allegation

As a registered Biomedical Scientist (BS28814) your fitness to practise is impaired by reason of misconduct. In that:  

1) You did not provide an adequate service whilst working within a blood transfusion laboratory. In that:  

a) On 12 March 2018 you entered 11 traceability tags with the incorrect date of transfusion;

b) On 8 May 2018 you placed an incorrect label on a unit of blood; 11 

c) On 18 May 2018 you incorrectly discarded a blood unit that had been returned following a transfusion;

d) On 26 July 2018 you placed an incorrect label on a unit of blood;

e) On 30 October 2018 you were obstructive in the process of issuing blood to the maternity ward during an obstetric code red situation.  

2) On 1 November 2018, you did not communicate professionally, in that you were rude to a doctor when the doctor rang to order platelets”.  

3) You did not inform the HCPC [in a timely manner] that you had been suspended from work on 2 November 2018.  

4) The matters described at particulars 1, 2 & 3 above constitute misconduct.  

5) By reason of your misconduct your fitness to practise is impaired

Notes

The Panel also decided to impose an Interim Conditions of Practice Order for a period of 12 months.

Order: The Registrar is directed to annotate the Register on an interim basis to show that, for a period of 12 months, you, Tamora Heath, must comply with the following interim conditions of practice:

1. In the event that you undertake any work for which your HCPC registration is required, you must place yourself and remain under the indirect supervision of a workplace supervisor registered by the HCPC or other statutory regulator, and you must supply details of your supervisor to the HCPC within 7 days of taking up the relevant employment. You must attend upon that supervisor as required and follow their advice and recommendations.

2. In the event that your health deteriorates in a respect that potentially affects your fitness to practise as a Biomedical Scientist, you must inform your supervisor of that fact immediately and inform the HCPC within 7 days.

3. Prior to every hearing at which this Interim Order is to be reviewed, you must provide the HCPC with written confirmation by your line manager or supervisor that they are not aware of any issues concerning your health or wellbeing and that they have no concerns about your practice.

4. You must keep your professional commitments under review and limit your professional practice in accordance with medical advice.

5. You must cease practising immediately if advised to do so by a medial practitioner, and you must inform the HCPC of any such advice within 7 days of receiving it.

6. You must inform the HCPC within 7 days of any work you undertake for which your HCPC registration is required.

7. You must inform the HCPC within seven days of becoming aware of:

A. any patient safety incident you are involved in;

B. any investigation started against you; and

C. any disciplinary proceedings taken against you.

8. You must inform the following parties of the following information: (i) that your registration is subject to these conditions: (ii) that you are subject to the on-going HCPC fitness to practise proceedings; and, (iii) the terms of the HCPC’s allegation in FTP 76385 (as amended at the Preliminary Hearing held on 28 March 2024:

A. any organisation or person employing or contracting with you to undertake professional work;

B. any agency you are registered with or apply to be registered with to undertake professional work (at the time of application);

C. any prospective employer for professional work (at the time of your application);

D. any organisation through which you are undertaking professional training.

9. You must allow the HCPC to share, as necessary, details about your performance, compliance with, and/or progress under these conditions with:

A. any organisation or person employing or contracting with you to undertake professional work;

B. any agency you are registered with or apply to be registered with to undertake professional work;

C. any prospective employer for professional work;

D. any organisation through which you are undertaking professional training.
