Allegation
The following Allegation was considered by a panel of the Health Committee at a Substantive Hearing on 09-11 February 2022.
As a registered Occupational Therapist (OT50207) your fitness to practise is impaired by reason of a health condition, in that:

Finding
Preliminary Matters
Service
1. The Panel was provided with a service bundle which included the following:
• Registrant’s registration certificate with an NHS email address. The Panel was informed by Ms Khorassani that this is the Registrant’s registered email address.
• Copy of a notice of hearing dated 6 February 2025 sent to the Registrant’s registered email address and to a personal email address which had been used by the Registrant in correspondence with the HCPC. This email contained the correct time and date of the hearing, and informed the Registrant that it would be conducted virtually. In error the notice referred to an Interim Order review rather than a Substantive Order review.
• Copy of a notice of hearing dated 7 February 2025 sent to the Registrant’s personal email address which contained the same information, but corrected the nature of the hearing.
2. The Panel accepted the advice of the Legal Assessor. She advised the Panel that the requirements in the Health and Care Professions Council (Health Committee)(Procedure) Rules 2003 were that the notice must be sent to the Registrant’s registered email address. The requirements in Rule 6 are that the notice must include the date, time, and venue of the hearing. There are no other requirements for a notice of a substantive review hearing.
3. Having considered the documents in the Service Bundle the Panel was satisfied that the requirements of the Rules had been satisfied. The notice sent on 6 February 2025 contained an error as to the nature of the hearing, but it correctly specified the details for today’s hearing and was sufficient to meet the requirements of the Rules.
Proceeding in absence
4. Ms Khorassani made an application for the Panel to proceed with the hearing in the absence of the Registrant. The Panel was referred to the case of GMC v Adeogba [2016]WCA Civ 162 in which the court stated that “there is a burden on all professionals subject to a regulatory regime, to engage with the regulator, both in relation to the investigation and ultimate resolution of allegations made against them. That is a part of the responsibility to which they sign up when being admitted to the profession”.
5. The Panel had regard to the HCPTS Practice Note on “Proceeding in the Absence of Registrant”. The Panel was mindful of the need to proceed with the utmost care and caution balancing fairness to the Registrant with the public interest.
6. The Panel was satisfied that reasonable steps had been taken by the HCPC to serve the Registrant with notice of today’s hearing. In addition to the Notice of Hearing, the HCPC had taken steps to inform the Registrant of the hearing using her personal email address and had provided her with details to join the hearing link.
7. The Panel was informed by Ms Khorassani that the Registrant had not communicated with the HCPC in these proceedings since the conclusion of the substantive hearing on 11 February 2022. The Panel inferred that she has waived her right to attend the hearing. Given her non-engagement over a substantial period of time, the Panel considered that an adjournment would serve no purpose.
8. The hearing is to review a substantive Suspension Order which is due to expire on 11 March 2025. The Panel was of the view that it was in the public interest to proceed with the hearing given the serious nature of the concerns raised, which included the need to protect the public. In balancing the Registrant’s interest and the public interest, the Panel determined that it was fair and in the interests of justice that the hearing should proceed in the absence of the Registrant.
Hearing in private
9. Ms Khorassani made an application for the entire hearing to be conducted in private on the grounds that the case concerned the Registrant’s health.
10. The Panel had regard to the HCPTS Practice Note on “Conducting Hearings in Private” and accepted the advice of the Legal Assessor. The Panel granted the application for the entire hearing to be conducted in private on the grounds advanced by Ms Khorassani.
Order
Order: The Registrar is directed to strike the name of Miss Julie Haydon from the register on the expiry of the existing Order.
Notes
The Order imposed today will apply from 11 March 2025.
