Allegation
As a registered Chiropodist/Podiatrist (CH08325) your fitness to practise is impaired by
reason of misconduct, in that:
1. On 10 June 2022, during a treatment session with Service User A you:
a. Took a photograph of Service User A's bottom on your personal phone.
b. Failed to record that you had taken a photograph of Service User A with your
personal phone.
c. Failed to carry out appropriate assessments and/or tests in diagnosing
Service User A with Hypermobility Spectrum Disorder (HSD).
d. Failed to make a referral for Service User A to an appropriate professional for
further diagnosis and/or treatment for HSD.
2. On 24 June 2022, during a treatment session with Service User A you:
a. Gave Service User A a shoulder massage:
i. Without having explained the reason for your actions.
ii. Without clinical justification.
iii. Without Servicer User A's full informed consent.
3. On 25 June 2022, during a treatment session with Service User A you:
a. Gave Service User A a full body massage:
i. Without having explained the reason for your actions.
ii. Without clinical justification.
iii. Without Servicer User A's full informed consent.
b. During the full body massage of Service User A you:
i. Moved towels covering Service User A to expose her bottom and
underwear.
ii. Massaged Service User A's bottom.
iii. Rubbed your fingers against Service User A's underwear.
iv. Rubbed your fingers against Service User A's labia.
v. Massaged Service User A's chest coming within 1cm of her nipples.
c. Asked for a hug instead of payment for your services.
4. You did not record adequate details of the clinical assessments and/or reasons for the treatment provided, in relation to your appointments with Service User A on:
a. 10 June 2022; and/or
b. 24 June 2022; and/or
c. 25 June 2022.
5. In respect of particulars 2a, and/or 3a you were working beyond your scope of practise as a Chiropodist/Podiatrist.
6. Your conduct at particulars 1a and/or 3b was sexually motivated.
7. The matters set out in particulars 1-6 above constitutes misconduct.
8. By reason of your misconduct your fitness to practise is impaired.
