Allegation
As a registered Occupational Therapist (OT70260) your fitness to practise is impaired by reason of misconduct and/or a health condition. In that:
- On or about 8 November 2019, you:

- Left Service User A at 'Housing Options' without any or any adequate handover to another professional;
- Discussed the health condition of Service User A in a raised voice and/or within the hearing of others thereby breaching Service User A's confidentiality.
- You have a [redacted] health condition as set out in Schedule A.
- The matters set out at any or all of Particulars 1(a) to 1(c) above constitute misconduct.
- By reason of your misconduct and/or health condition your fitness to practise is impaired.

Preliminary Matters
Papers available to the Panel
1. The Panel was provided with a Review Bundle of 43 pages. On the morning of the hearing, the Registrant provided a second copy of a document that had previously been submitted to the HCPC [redacted].
Proceeding in private
2. Ms Yeghikian, on behalf of the HCPC made an application for all of this hearing to be conducted in private as the case is solely connected with matters of a personal or health nature relating to Ms Jamal. Ms Jamal supported the application for the hearing to be held in private. The Panel accepted the advice of the Legal Assessor and considered the relevant HCPTS Practice Note ‘Conducting Hearings in Private’.
3. The Panel was aware that as a starting point, all hearings should be held in public. Where there are overriding considerations, such as matters that are related to a registrant’s health or private family life, the public interest in hearings held in open session can be overridden. Rule 10 provides the Panel with a discretion to consider such issues of a personal or health nature in private. The right to respect for private life is protected in Human Rights legislation.
4. The Panel gave this matter full consideration and agreed to the application to conduct the hearing entirely in private as it solely related to matters of a personal or health nature for Ms Jamal.
Order
ORDER: The Registrar is directed to vary the Conditions of Practice Order against the registration of Sainab Jamal for a further period of 6 months on the expiry of the existing order. The Conditions are:
1. Upon obtaining employment as an Occupational Therapist, you must place yourself and remain under the supervision of workplace supervisor registered by the HCPC or other appropriate statutory regulator and supply details of your supervisor to the HCPC within 21 days of commencing work. You must attend upon that supervisor as required by them and follow their advice and recommendations.
2. You must authorise your supervisor to provide the HCPC with information about your work record, conduct and compliance with condition 1, before the next review of this order.
3. You must register with and remain under the care of a General Practitioner and/or occupational health specialist and inform him or her that you are subject to these conditions.

5. You must keep your professional commitments under review and limit your professional practice in accordance with the advice of your General Practitioner/occupational health specialist.
6. You must cease practising immediately if you are advised to do so by your General Practitioner/occupational health specialist.

11. You must promptly inform the HCPC if you take up any employment.
12. You must promptly inform the HCPC of any disciplinary proceedings taken against you by your employer.
13. You must inform the following parties that your registration is subject to these conditions:
A. any organisation or person employing or contracting with you to undertake professional work;
B. any agency you are registered with or apply to be registered with (at the time of application); and
C. any prospective employer (at the time of your application).
14. You will be responsible for meeting any and all costs associated with complying with these conditions.
15. Any condition requiring you to provide any information to the HCPC is to be met by you sending the information to the offices of the HCPC, marked for the attention of the relevant Case Manager.
