Order
ORDER: The Interim Conditions of Practice Order made on 22 April 2025 is varied. The conditions are:
1) In relation to any instruction you receive to act as an expert witness and/or to prepare an expert report, before accepting that instruction you must inform the instructing party that you are subject to this interim conditions of practice order and provide a copy of these conditions.
2) In relation to any expert report you prepare or submit, you must include a statement that you are subject to an interim conditions of practice order and include the conditions in the report.
3) You must continue to identify one or more peer supervisor(s) and communicate the identity of the individual(s) whom you choose to the HCPC. The selected supervisor(s) must be a registered Practitioner Psychologist with the HCPC.
4) In relation to each expert report you prepare and propose to submit, before signing off that report, you forward the report to a supervisor for peer review, together with an overview of the evidence and information used to prepare the report.
5) You must maintain a log of all expert reports you prepare, identifying the supervisor to whom the report was forwarded for peer review.
6) A copy of the log referred to in condition (5) must be submitted to the HCPC not less than 14 days before any review of this Order.
7) You must arrange to meet with your supervisor(s) not less frequently than fortnightly to discuss your work as an expert witness. For the avoidance of doubt, these meetings can be undertaken remotely by video conferencing.
8) You must arrange for your supervisor(s) to prepare a written report on the peer review they have undertaken of your expert reports and on your fortnightly discussions, and submit the same to the HCPC not less than 14 days before any review of this Order.
9) For the avoidance of doubt, throughout these conditions, an "Expert Report" includes all Civil Procedure Rules Part 35 Responses, including those relating to reports written by the Registrant prior to 22 April 2025.
Notes
This Order will be reviewed by the Committee no later than 29 January 2026 or earlier if new evidence which is relevant to the Order becomes available after it was made.
