ORDER: The Registrar is directed to impose the following conditions on the registration of Mark Behan for the remainder of the period of the Order (namely until 22 June 2027): 

1. You must confine your professional practice to working with North Midlands Pathology Service based at the University Hospitals of North Midlands NHS Trust (the Trust).

2. You must not carry out tissue sampling or tissue transfer procedures.

3. You must place yourself and remain under the direct supervision of a workplace supervisor, registered by the HCPC, at least one grade above you, and supply details of your supervisor to the HCPC within one month of the Operative Date. You must attend upon that supervisor as required, not less than once a month, and follow their advice and recommendations.

4. You must remain under the direct observation and supervision of your workplace supervisor in all aspects of your role as a Biomedical Scientist at the Trust until such time as your workplace supervisor is able to sign you off as being competent in all aspects of your role.

5. When you are deemed to be competent to practise autonomously in all aspects of your role as a Biomedical Scientist with the Trust, you must invite your workplace supervisor to prepare a report and submit it to the HCPC within 14 days of being deemed competent, outlining the work which has been undertaken to achieve your competence, and why they have considered it appropriate to sign you off as being competent.

6. You should invite your supervisor to submit reports to the HCPC every three months, prior to any review of this Order, outlining your current progress towards becoming an autonomous competent Biomedical Scientist.

7. You must inform the HCPC within seven days if you cease to be employed by your current employer.

8. You must inform the HCPC within seven days if you take up work requiring registration with a professional body outside the United Kingdom.

9. You must inform the HCPC within seven days of becoming aware of:

    A. any patient safety incident you are involved in;

    B. any investigation started against you; and

    C. any disciplinary proceedings taken against you.

10. You must inform the following parties that your registration is subject to these conditions:

    A. any organisation or person employing or contracting with you to undertake professional work;

    B. any agency you are registered with or apply to be registered with to undertake professional work (at the time of application);

    C. any prospective employer for professional work (at the time of your application);

    D. any organisation through which you are undertaking professional training.

This order will be reviewed by the Committee no later than 06 November 2026 or earlier if new evidence which is relevant to the Order becomes available after it was made.

Right to Apply to the Court
Under Article 31(12) of the Health Professions Order 2001, you may apply to the appropriate court to revoke or vary the conditions imposed.
