Allegation
The following Allegation against the registrant was considered by a Panel of the Health Committee at a Substantive Hearing on 21 November 2019.
Your fitness to practice as a Chiropodist is impaired by reason of your physical and/or mental health as described in Schedule A.
Finding
Preliminary Matters
Application to proceed in private
1. Ms Hastie applied for the entirety of the hearing to be heard in private, on the basis that the Panel was sitting as a Panel of the Health Committee and that all matters essentially concerned the Registrant’s health.
2. The Panel heard and accepted the advice of the Legal Assessor. It had regard to the HCPC’s Practice Note ‘Conducting Hearings in Private’. The Panel was of the view that the case exclusively related to matters concerning the Registrant’s health, and as such it was not appropriate for such matters to be aired in public. It was, therefore, satisfied that it was justified to hear the entirety of the case in private, in accordance with Rule 10(1)(a) of the Health Committee (Procedure) Rules 2003.
Order
The Registrar is directed to further suspend the registration of Mr David Cruickshanks for a period of 6 months upon the expiry of the current Order.
Notes
The Order imposed today will apply from 19 September 2021.
This Order will be reviewed again before its expiry on 19 March 2022.
