Finding
Preliminary Matters
Proceeding in private
1. Ms Sampson applied to the Panel for the hearing to proceed in private. She submitted that the hearing would necessarily consider the Registrant’s health and, in order to protect her private life, it would be appropriate to sit wholly in private.
2. The Legal Assessor reminded the Panel of Rule 10(1)(a) of the Rules. This provides that usually hearings are conducted in public, but a panel may decide to sit wholly or partly in private if it is satisfied that the interests of justice or the protection of the private life of the registrant (or certain specified others) so requires.
3. The Panel decided that it was appropriate to sit in private, since the need to protect the Registrant’s private health matters when referred to in the hearing outweighed the need to sit in public, and it considered that the whole of the hearing would be concerned with the Registrant’s health.
Order
The Registrar is directed to suspend the registration of Miss Ashley McLeavy for a further period of 12 months on the expiry of the existing order.
Notes
The Order imposed today will apply from 19 February 2025.
This Order will be reviewed again before its expiry on 19 February 2026.
