Allegation
As a registered Paramedic, your fitness to practise is impaired by reason of caution and/or misconduct and/or a health condition. In that:
1. On 5 July 2021, you accepted a Caution from Greater Manchester Police for sending by public communication network an offensive/indecent/obscene/menacing message/matter; stalking involving serious alarm/distress; and sending a letter/communication/article conveying a threatening message.
2. On 17 June 2021, you attended your place of work:
a) Under the influence of alcohol; and
b) After having driven to the location whilst over the prescribed limit for alcohol.
3. You have a physical or mental health condition as set out in Schedule A.
4. The matter set out in particular 2 above constitutes misconduct.
5. By reason of your caution and/or misconduct and/or health your fitness to practise is impaired
Finding
Preliminary Matters
Service and Proceeding in Absence
1. The Panel was satisfied that all relevant steps in relation to service of Notice of this review hearing was carried out in accordance with Rule 3 of The Health and Care Professions Council (Health Committee) (Procedure) Rules 2003 (the Rules). Notice had been sent to the Registrant at his registered address on 16 April 2025 informing of the date, format, and purpose of the review together with remote joining instructions.
2. The Panel decided to proceed in the Registrant’s absence. It exercised its discretion to do so under Rule 11, carefully and fairly, having heard submissions from Ms Yeghikian and advice from the Legal Assessor. The Panel followed the Appeal Court’s guidance in Adeogba v General Medical Council [2016] UKCA Civ 162. There was no application by or on behalf of the Registrant to adjourn the review and given his lack of attendance since the final substantive hearing and lack of engagement since the first review, there is nothing to suggest that he would attend at a later date.
Proceeding in private
3. The Panel decided to proceed entirely in private session. Ms Yeghikian, on behalf of the HCPC made an application for any matters of a personal or health nature relating to the Registrant to be discussed in private session. The Panel accepted the advice of the Legal Assessor and considered the relevant HCPTS Practice Note Conducting Hearings in Private. In accordance with Rule 10.(1)(a), all hearings should be held in public where possible, but where an overriding exception applied such as matters related to a person’s private and family life, respect must be accorded to protection of privacy as provided for in Article 8 of the European Convention on Human Rights. The substance of this review related entirely to the Registrant’s health and so the exception provided for in the Rules applied and the entirety of the hearing was held in private.
Order
The Registrar is directed to strike the name of Mr Waheed Ahmed Ghauri from the Register on the date this order comes into effect.
Notes
The Order imposed today will apply from 2 June 2025.
